Why Derby Brain Injury Victims Turn to Hutton & Hutton Law Firm, LLC

General personal injury experience matters, but landmark brain-injury verdicts matter more when your claim involves catastrophic, life-altering harm. As the oldest personal injury litigation firm in Kansas, Hutton & Hutton Law Firm, LLC has served as lead counsel in some of the most significant brain injury cases in the state’s history.

Landmark Brain Injury Verdicts

Our attorneys represented the family in a birth-injury case where a jury awarded $23.6 million after a child suffered brain injury and cerebral palsy, which stood as the largest jury verdict in Kansas and one of the largest personal injury verdicts in the nation at the time. We also served as lead counsel in Graham v. Wyeth Labs, 666 F.Supp. 1483 (D. Kan. 1987), where a jury awarded $15 million after our client suffered severe brain damage from a vaccine reaction. These cases aren’t just credentials. They’re evidence of the kinds of claims we’re capable of building for clients with brain injury claims.

How We Build Derby Brain Injury Cases

We collaborate with accident reconstruction professionals and medical authorities who can explain the nature and permanence of a brain injury to a jury. Judges, doctors, and opposing attorneys recognize our firm as formidable advocates, and that recognition shapes how cases are negotiated and tried.

What Qualifies as a Traumatic Brain Injury

A traumatic brain injury (TBI) results from severe blunt-force trauma to the head or the piercing of the skull by a foreign object. TBIs aren’t always immediately visible. They range from concussion-level mild injuries to severe, permanent damage affecting cognition, motor function, speech, and personality. Depending on the severity and location of the damage, a TBI can leave a person permanently disabled or can result in death.

These injuries most often arise from vehicle collisions, but construction accidents, dangerous products, botched brain surgeries, and pedestrian accidents are also common causes. If you’re uncertain whether your situation qualifies, a conversation with a brain injury lawyer familiar with Derby and Sedgwick County claims is a helpful first step.

Compensation a Brain Injury Claim Can Recover

A successful personal injury or workers’ compensation claim can pursue reimbursement across several categories of harm:

  • Pain and suffering
  • Present and future medical expenses, including long-term rehabilitation and care
  • Lost wages from time unable to work
  • Lost earning potential when the injury limits the ability to return to prior employment

Compensation amounts vary significantly by case. An individualized legal evaluation can help you understand what your situation may support.

Kansas Filing Deadlines & Fault Rules That Affect Derby Claims

Two legal rules shape almost every brain injury claim arising in Derby, Kansas.

Statute of Limitations

Kansas gives most personal injury claimants two years from the date of the incident to file. If the injury resulted in a fatality, the family generally has two years from the date of death to file a wrongful death claim. Certain factors, such as the injured party being a minor, can alter these deadlines. Waiting to consult a brain injury attorney can risk losing the right to file entirely.

Kansas Modified Comparative Fault

Kansas follows a modified comparative fault rule codified at K.S.A. 60-258a. An injured person can still recover damages if their own share of fault is less than 50 percent, but recovery is reduced by that percentage. A person found 50 percent or more at fault recovers nothing. How fault is allocated matters enormously, which is one reason accident reconstruction and thorough factual investigation are central to how we build these cases.

Where a Derby Brain Injury Lawsuit Is Filed

Derby has its own municipal court, but it handles only city ordinance violations such as traffic citations and misdemeanor matters. Civil lawsuits aren’t filed there. A personal injury claim arising in Derby is filed in the Sedgwick County District Court, the 18th Judicial District, located in Wichita. Our attorneys are well acquainted with that court and the procedures governing civil claims filed there.
